Customer Registration and Account
You must provide accurate, complete and current information when creating and using your account, including your name or business name, active contact details and any information reasonably required to arrange a Transport Service.
Keep your login credentials confidential and notify Swing promptly if you suspect unauthorised access. You are responsible for activity carried out through your account, except to the extent caused by Swing's failure to meet its legal obligations.
You must be legally capable of entering into the relevant agreement. Where you act for a business or another person, you confirm that you are authorised to do so.
Posting a Job
When posting a Job, you must provide clear and accurate details so Carriers can assess and price the request.
- Provide correct pickup and destination locations and any relevant access instructions.
- Describe the cargo accurately, including quantity, size, weight, handling needs and any special risks, where applicable.
- For passenger transport, state the number of passengers and relevant journey requirements.
- Select a suitable service and provide realistic dates and times.
- Disclose any loading, offloading, waiting-time or other requirements that may affect the service or price.
Do not post false, misleading, unlawful or duplicate Jobs. Swing may remove or restrict a Job that appears incomplete, unsafe or inconsistent with these Terms.
Bids and Selecting a Carrier
Carriers may submit Bids for Jobs made available to them. You are responsible for reviewing the Bid amount, Carrier information, vehicle details, service description and any relevant conditions before making a selection.
You may choose a Bid that best meets your requirements. Submitting or receiving a Bid does not itself confirm a booking. A booking is confirmed through the applicable acceptance and payment-verification process on Swing.
Swing may verify Carrier information and display verification status, but verification is not a guarantee of a Carrier's future conduct, service quality or performance. Make your selection carefully and use the information made available on the Platform.
Commitment Fee and Payments
When you accept a Carrier's Bid, you are required to pay a commitment fee equal to 10% of the accepted Bid amount. The fee is paid by you, the Customer, and is deducted from the total accepted price; it is not an additional charge on top of the Bid amount.
For example, if the accepted Bid is KSh 20,000, the commitment fee is KSh 2,000 and the remaining balance is KSh 18,000. The commitment fee must be received and verified through Swing before the booking is treated as confirmed and the relevant Carrier contact details are released in accordance with the Platform process.
The remaining balance is payable to the Carrier in accordance with the payment arrangements communicated for the Job. You should retain payment confirmations and receipts. Do not make additional payments that have not been agreed or properly communicated.
Customer Responsibilities During the Service
Provide reasonable access to the pickup and delivery locations and ensure that the cargo or passengers are ready at the agreed time. Make sure that all information and instructions you provide are accurate.
You must cooperate with the Carrier, treat them respectfully, comply with reasonable safety instructions and promptly communicate any change that may affect the Job.
You must not ask a Carrier to carry out unlawful activities, transport prohibited goods or exceed lawful passenger or cargo limits.
Cargo and Passenger Safety
- Do not request transportation of illegal, prohibited or dangerous goods.
- Accurately disclose fragile, hazardous, high-value or special-handling cargo before the Carrier accepts the Job.
- Ensure that cargo is appropriately packed and ready for safe transport, unless packing has been expressly agreed as part of the service.
- For passenger services, ensure passenger numbers and journey details are accurate and comply with applicable laws and safety requirements.
- Promptly inform the Carrier of relevant access, loading, delivery or passenger assistance requirements.
Carriers remain responsible for operating their vehicles and providing transport services in accordance with applicable law. Customers remain responsible for the accuracy and lawfulness of their requests and the items they tender for transport.
Changes, Cancellations and Delays
If you need to change or cancel a Job, contact the Carrier and Swing as soon as possible through the available Platform or support channels. A change to the route, cargo, passenger numbers, timing or other material details may require the Carrier's agreement and may affect the price.
A Carrier may also experience delays or circumstances that affect a Job. Communicate promptly and retain relevant messages and payment records.
Any cancellation, refund or adjustment will be handled in accordance with the cancellation terms or payment conditions presented for the relevant transaction, the facts of the case and applicable Kenyan law. Do not assume that a payment is automatically refundable or non-refundable unless the applicable terms say so.
Complaints, Claims and Disputes
Raise service concerns, suspected fraud, damage, loss, non-performance or payment disputes with Swing through the designated support channel as soon as reasonably possible. Provide the Job reference, a clear description and relevant supporting evidence, such as photographs, messages and receipts.
Swing may review information available to it and facilitate communication between the parties. The Customer and Carrier remain responsible for their respective obligations in relation to the Transport Service. Nothing in these Terms removes rights or remedies that cannot lawfully be excluded under Kenyan law.
Swing's Role and Liability
Swing provides the digital marketplace through which Customers and independent Carriers can connect, exchange Bids and arrange Transport Services. Unless expressly stated otherwise, Swing is not the transport operator and does not itself drive, carry cargo or transport passengers.
Swing may review accounts, verify information, provide Platform support and take reasonable steps to address misuse. However, Swing does not guarantee that a Job will receive Bids, that a particular Carrier will be available or that a Carrier will perform a Job in a particular way.
To the extent permitted by applicable law, Swing is not responsible for acts or omissions of independent Carriers or Customers, or for loss arising from the transport service itself. This does not exclude liability that cannot legally be excluded.
Privacy, Account Restrictions and Governing Law
Swing processes personal information in accordance with its Privacy Policy and applicable Kenyan data protection law. Customer contact information is shared with a selected Carrier in accordance with the booking and payment-verification process and should only be used for the relevant Job.
Do not misuse the Platform, submit false information, interfere with its operation, harass other users or use Swing for unlawful purposes. Swing may restrict, suspend or close an account where these Terms or applicable law are breached, subject to applicable legal requirements.
Swing may update these Terms from time to time. The current version will be made available through the Platform. These Terms are governed by the laws of Kenya.
Customer Acknowledgement
By using Swing, you confirm that the information you provide is accurate, you have authority to request the relevant service, you understand the 10% Customer commitment-fee arrangement, and you agree to use the Platform lawfully and respectfully.
